Republican Senators Introduce Bill to Repeal California Vehicle Emissions Waivers

Reuters reported that Sens. Cynthia Lummis of Wyoming, Eric Schmitt of Missouri, Pete Ricketts of Nebraska and Jon Husted of Ohio unveiled the proposal, arguing that California’s regulatory framework has effects well beyond the state’s borders because automakers often build vehicles to comply with its standards.

The legislative effort follows a June decision by the U.S. Environmental Protection Agency to transmit California’s Clean Air Act waivers to Congress for possible review under the Congressional Review Act, Reuters reported. The EPA said the waivers, which were approved during prior Democratic administrations, should have been submitted to lawmakers under the law.

California has challenged that move in federal court, arguing that sending the waivers to Congress under the Congressional Review Act is unlawful, according to Reuters. The review process is significant because it allows Congress to overturn covered agency actions with a simple majority vote rather than the 60-vote threshold that most Senate legislation requires.

In a statement cited by Reuters, the senators said the waivers have enabled the California Air Resources Board “to impose its regulatory agenda far beyond California’s borders.”

The proposal comes amid a broader Trump administration campaign to reduce California’s ability to set its own environmental standards. Reuters reported that the administration has pursued multiple policies aimed at expanding the market for gasoline-powered vehicles while reducing incentives for electric vehicle adoption.

The California waivers authorize the state to establish emissions requirements covering passenger vehicles, trucks and certain categories of outdoor power equipment. Reuters reported that those standards have encouraged manufacturers to produce cleaner vehicles, including electric models, to comply with increasingly strict emissions limits.

Among the waivers targeted is approval granted in 2022 by the EPA under then-President Joe Biden for California’s Advanced Clean Cars I program, Reuters reported. The program remains in force and requires automakers to increase sales of electric vehicles while meeting emissions limits that exceed federal standards.

The dispute also reflects competing views over the costs and benefits of stricter environmental rules. Reuters reported that the Trump administration plans to roll back federal fuel-economy requirements, while California maintains that fuel savings over the life of vehicles outweigh the higher upfront purchase prices associated with many electric models.
