SAP Says German Antitrust Authority Ends Preliminary Review Without Formal Case

Germany’s federal competition authority has decided not to open formal antitrust proceedings against software company SAP after completing a preliminary review, according to a statement published Thursday by SAP News.

    SAP said the German Federal Cartel Office, known as the Bundeskartellamt, concluded its initial inquiry without launching abuse-of-dominance proceedings, according to the company’s published statement.

    According to SAP News, the company welcomed the regulator’s decision, saying it views the outcome as confirmation that no formal enforcement action will move forward based on the preliminary examination.

    The statement, published by SAP News, did not provide additional details about the scope of the preliminary inquiry or explain what issues the competition authority had reviewed. It also did not include a statement from the Bundeskartellamt.

    The announcement comes weeks after European Union regulators accepted commitments from SAP intended to address competition concerns involving maintenance and support services for the company’s on-premises enterprise software, according to Reuters. Under that separate EU matter, SAP agreed to measures designed to make it easier for customers to switch support providers or end certain service arrangements, allowing the company to avoid a potential antitrust penalty.
