South Africa: End of ID card case draws jurisdiction lines for Commission

South Africa’s Competition Commission decided not to refer a case to the Tribunal following a complaint regarding the tender process of the smart ID card system, officially closing the matter.

Batho Phahameng Consulting issued a complaint with the Commission claiming the company was unjustly disqualified from the tender process. But the Commission ruled that it does not have the jurisdiction to rule on such complaints regarding allegations of fraudulent tenders.

In response, the company said it would pursue the matter with the auditor-general and the presidency.

The tender allowed companies to competitively bid for printing equipment for the new smart identification cards.
