South Africa: Settlement offered in HIV testing market collusion

A company involved in conspiring to rig tenders for supplying and distributing HIV rapid test kids has reportedly offered to settle with the Competition Commission, a resolution that remains subject to approval to the Competition Tribunal. Shekinah Medical & Disposables made the settlement offer after regulators received complaints about the company, along with its competitor Hosanna Medical & Disposals, concerning the issue in 2011; the case was referred to the Tribunal. The Tribunal is set to decide this week whether to accept the offer, 5 percent of the company’s annual turnover. Reports say the nation’s Treasury received 70 bids for the contracts, though the two received from the companies in question led the Treasury to suspect the competitors were colluding.
