South Africa: Telkom could dodge Tribunal hearing

Telkom has reportedly entered into settlement discussions with the nation’s Competition Commission, possibly bypassing the Competition Tribunal in an effort to avoid the same outcome of a previous case that lasted for over a decade due to the appeals process. In the previous case, the fixed-line telecom operator was fined by the Tribunal for anticompetitive behavior. This time, the parties are hoping to avoid another lengthy legal process concerning a case that reports say are broad and similar to the last one, with differences involving the duration and timeline of the offenses. According to reports, Telkom wants the Commission-induced fine reduced, while the Commission wants the Tribunal to impose an even greater fine.
