Supreme Administrative Court agrees that National Health Insurance Fund abused its dominance
The Supreme Administrative Court has upheld the Bulgarian competition watchdog’s 2010 ruling that the National Health Insurance Fund has abused its dominant position. The Commission on Protection of Competition had fined NHIF BGN 30,000 for imposing lower mark-up ceilings for medication on the NHIF Reimbursement List sold at pharmacies, from 2008 to 2009. Retail pharmacy mark-ups are set by regulation.
