Supreme Court affirms TDLC’s approval of LAN-TAM merger, including mitigations

The Chilean Supreme Court has confirmed the Antitrust Authority (Tribunal de Defensa de la Libre Competencia)’s approval of the LAN-TAM merger. The approval also extends to the 14 mitigation measures that LAN had sought to overturn on illegal and unconstitutional grounds. The measures include code-share agreements, obligations to give up some flights, and surveillance requirements. LAN has announced that it will continue to move forward with the merger.
