Tribunal clears Thaba Chueu’s acquisition of SamQuarz

The South African Competition Tribunal has approved, with conditions, Thaba Chueu’s acquisition of SamQuarz. The merger had been blocked by the Competition Commission and the Department of Trade and Industry, even after the parties made agreements and commitments to ease concerns with silica market foreclosure and the ability of new entrants to compete. The Tribunal, however, found that the long-term supply agreements with Sublime Technologies and Silicon Technology and supply commitments to new entrants did provide sufficient protection.
