U.S.: Lawyer hopes to fight for small pharmas’ ability to compete

A lawyer continued efforts to represent a group of independent pharmacies in federal court when he applied to certify the class to U.S. District Court Judge Darnell Jones in Philadelphia. Attorney Joe Whatley Jr. is hoping to represent the group to bring a suit against another group of pharmacy benefit managers under the accusation that they suppressed competition in the sector; specifically, Whatley Jr. argues that the benefit managers deflated sales compensation paid to the independent pharmacies. Working against him is the fact the case lacks expert testimony to show how those independent pharmacies have suffered as a consequence of the alleged deflated compensation.
