U.S.: Supreme Court to rule on relationship between federal antitrust law, nonprofit health care providers

The U.S. Supreme Court will hear an antitrust case made by the Federal Trade Commission against Phoebe Putney Health Systems Inc. The case stems from FTC charges that the state of Georgia allowed Phoebe Putney to acquire the only other hospital in the area, Palmyra Medical Center, in addition to its already existing 40-year lease on Albany-Dougherty County’s public hospital. Experts say the case can affect how other nonprofit hospitals and health care providers are impacted by federal competition law; Phoebe Putney is an independent nonprofit company.
