UK: Appeal Tribunal upholds nearly $10M fine against Tesco, reverses some OFT findings

The Competition Appeal Tribunal has held up a nearly $10 million fine issued to Tesco grocery chain by the Office of Fair Trading. Tesco had appealed the OFT’s findings from a 2011 investigation, part of its Dairy Retail Price Initiative, that Tesco had violated antitrust law three times by fixing prices of cheese in 2002. The CAT, however, found that Tesco did not violate legislation in regards to additional findings concerning the exchange of future pricing information, according to the OFT.
