UK: OFT’s decision against Tesco cheese collusion upheld by Appeal Tribunal

The Competition Appeal Tribunal has released its decision regarding UK Supermarket conglomerate Tesco’s appeal of the Office of Fair Trading’s ruling that Tesco had restrained competition in the sector in what is now known as the 2002 and 2003 cheese initiatives. After a five-week trial in April and May of last year, the CAT has upheld the OFT’s finding that Tesco had restricted competition on three occasions by indirectly exchanging its pricing plans for its cheese supplies with other retailers. The CAT ruled in late-December of last year.
