US: E-book trial to begin early June for Apple, but will Penguin join?

As reports suggest that June 3 will be the date for trial against Apple Inc. to begin in a case initiated by the US Department of Justice for price-fixing, stipulation mounts over whether e-book publisher Penguin will be joining Apple as a defendant. Penguin is currently in limbo the last remaining publisher of the case has yet to finalize a settlement in multiple cases. If an agreement is not made, reports say Penguin risks a consolidated bench trial to include the case filed by the DOJ, a group of state attorneys general, and a class action. While the case with the DOJ has been settled, the publisher requested a separate trial for the unsettled cases – a request that has been denied by Judge Denise Cote, who will require that Penguin join Apple as a defendant.
