US: Dow Chemicals remains stuck in price-fixing web

Dow Chemicals remains entangled in litigation regarding allegations of price-fixing as a federal judge in Kansas has denied Dow’s motion to dismiss claims against the company, reports say.

    Plaintiffs are pursuing new claims against Dow after opting out of the company’s $1.2 billion class action settlement, reached last May.

    The claims stem from cases beginning in 2005 against Dow and other chemical makers for price-fixing allegations.

    The plaintiffs in this case include Carpenter, Woodbridge Foam and others. Dow has reportedly sought for dismissal of the case due to the fact that current and former company executives invoked the Fifth Amendment.

    But in a decision made by judge John W. Lungstrum earlier this week, Dow failed to show “that those invocations have interfered with the court’s docket or the judicial process in general.”
