US: Grocery giants back in fight after antitrust suit dismissal overturned

According to reports, the 8th Circuit revived an antitrust case against major wholesale grocers last Wednesday. The court reversed a lower court’s ruling dismissing the case against C&S Wholesale Grocers Inc. and SuperValu Inc. who were charged by five other grocers with collusion and price-fixing. The accusations stem from an agreement made in 2003 between the two grocery giants to not compete in the Midwest and New England and to exchange assets and the plaintiffs argue the deal lead to overpricing of products in the two regions.
