A top US lawyer recently spoke at a conference in Washington where he placed focus on four cases for the Supreme Court, two antitrust and two patent cases, as the most important business cases this term. The top advocate for the Supreme Court under the Obama administration, solicitor General Donald Verrilli, made his remarks at an event at Georgetown Law Center. Perhaps most notable is his comment that the Federal Trade Commission, in a way, “won” in the Supreme Court in the court’s unanimous decision in FTC vs. Phoebe Putney Health System; decided last February, the Court ruled that the local hospital authority was not immune to federal antitrust law. Verrilli also mentioned the current FTC vs. Actavis course, which will be argued on March 25 concerning pay-for-delay pharmaceutical deals.
