US: Still no case against Apple for iTunes downloads, says appeals court

An appeals court Tuesday upheld a previous dismissal of a court against Apple Inc., which claimed the tech giant acted anti-competitively by barring consumers from playing music purchased through its iTunes music store on non-Apple devices.

The US Court of Appeals in San Francisco upheld the dismissal Tuesday, finding that Apple’s iTunes prices remained the same after competitors entered the market.

It’s the second win for the tech giant, which also won the dismissal of a case claiming Apple maintains a monopoly over its iPhone applications. That case was dismissed last month.

While Apple will not have to face this particular antitrust lawsuit, the company is awaiting the repercussions of a larger case, which found that Apple fixed eBooks prices. US District Judge Denise Cote found last July that the company conspired with eBooks publishers. Judge Cote is now mulling the penalties to be issued on Apple, which could include the establishment of a watchdog just for the tech giant.
