El Congreso de EEUU ha resuscitado un proyecto de ley que data de hace más de una década, el cual castigaría a los cárteles petroleros que se confabulan con la producción, quedando sujetas sus actividades a la Ley Sherman. En el pasado, los tribunales han decidido otorgar inmunidad a los gobiernos extranjeros. La Iniciativa de Rechazo a los Carteles de Productores y Exportadores de Petróleo (NOPEC, por sus siglas en inglés) sometería a la OPEP a atenerse a leyes antimonopolio al eliminar un escudo de inmunidad estatal creado por un precedente judicial.
