Ireland: Increased merger thresholds start next year

It is expected that turnover thresholds which determine whether mergers and acquisitions are required to notify the Competition and Consumer Protection Commission in Ireland (“CCPC”) will increase on January 1, 2019.

    These expected increases follow a public consultation on the merger provisions of the Competition Act 2002-2017 by the Department of Business, Enterprise and Innovation. The consultation concluded that the current thresholds are too inclusive, meaning that many transactions have to submit notice despite the fact that they do not have a substantive impact on competition in Ireland.
