Spain: CNMC pushes to tighten confidentiality in violation disclosure

Spain’s National Commission of Markets and Competition (CNMC) has issued a recommendation, pushing to tighten privacy protections for those who come forward to denounce infringements in hopes of protecting them from possible reprisals.

    The recommendation is part of the information given to the Ministry of Justice in its consultation on the Draft Law on Business Secrets. The CNMC has expressed its approval for this initiative from the point of view of effective competition .

    The CNMC has also recommended “improving the concept definition of “business secrecy” in order to avoid illegally obtained information from being protected”.

    The Regulator highlighted the similarities between competition law and intellectual property law, since the protection of these secrets plays an important role in encouraging competition and innovation.
