Australia: ACCC wins as court rules JJ Richards contracts unfair

The competition watchdog’s first small business unfair contracts action has ended in a Federal Court declaration that eight terms in the standard-form contract used by waste management firm JJ Richards & Sons are unfair and void.

    The declaration by consent resulted from the action by the Australian Competition and Consumer Commission under the protections for small businesses against unfair contracts in the Australian Consumer Law introduced on in November 2016.

    JJ Richards is one of the biggest players in the waste-management sector and provides recycling, sanitary and green waste collection services to businesses across Australia.

    A significant proportion of the 26,000 contracts entered into or renewed by JJ Richards since November 12, 2016 are thought to be impacted by the case.
