Spain’s Competition and Markets regulator, CNMC, has issued a series of recommendations intended to improve the Public Administration’s procedures for contracting out IT services. These recommendations include a push for Dynamic Acquisition Systems, as well as measures to minimize the likelihood of “collusive behavior.”
Among these recommendations, from a perspective of improving effective competition and efficient economic regulation, the report advocates the use of Dynamic Acquisition Systems which, it argues, would represent “a clear incentive towards efficiency” by providing a procedure that dynamically responds to competition throughout its run.
The CNMC’s report goes on to recommend a reinforcement of deterrents to possible collusion by operators by improving the degree of knowledge about competition rules and regulations, among other technical recommendations for improving interrogations of economic agents, as well as the possible use of alternative and more efficient ways to measure market dynamics.
