The lead plaintiff in a class action accusing various animation studios of anticompetitive non-poaching collusion is calling for the immediate dismissal of his own suit, say reports.
Animator Van Phan told his lawyers Monday, say reports, that he had not intended to file a suit to launch a new class action against the studios, which include DreamWorks Animation, Sony Pictures Animation, Disney, Pixar and others.
”It was never my intent nor would I intentionally agree to be lead plaintiff in this new class action,” Phan said. “I thought I was opting in to a pre-existing suit. I didn’t do my due diligence and I made an incorrect assumption.”
Phan’s lawsuit was filed in addition to three separate class actions filed against the studios with similar claims of non-poaching agreements. Those three suits were consolidated and will not be dismissed along with Phan’s case.
Reports say the suit could be dismissed within the next few days.
