Mexico’s Federal Economic Competition Commission, known as COFECE, has published its Regulatory Provisions that outline its exact powers to enforce federal competition laws.
According to COFECE, the Federal Economic Competition Law’s Regulatory Provisions are also part of an effort to ensure that companies know their rights and are educated on the application of federal competition laws.
COFECE published the Provisions on Tuesday after public consultation and approval by the regulator’s Board of Commissioners. According to the watchdog, the rules aim to provide legal certainty to companies regarding the application and enforcement of competition rules.
Among the provisions includes COFECE’s power to launch an investigation into alleged anticompetitive conduct based on an objective cause, the power to take enforcement actions to combat anticompetitive conduct, and the ability to penalize company executives found to have engaged in anticompetitive conduct.
In its announcement of the provisions, COFECE says the rules “allow firms to comprehensively understand their rights, ‘the how, when and why’” of competition law in the nation.
