San Jose’s efforts to have the Oakland A’s Major League Baseball team be transferred to San Jose have lead to a call for an appeals court to revisit the Supreme Court decision that lead to MLB’s exemption from antitrust law.
Reports say the city filed Wednesday a federal appeal to an earlier ruling that dismissed its case last year in a case that seeks another look at the antitrust exemption for professional baseball, a precedent set in 1922 by the Supreme Court.
Joe Cotchett, who represents the city in the law suit, told reporters that “in today’s day and age, when competitors operate in the marketplace, they cannot divide up a territory.” He is referring to San Jose’s struggle to bring the A’s to the city due to MLB team the Giants, which have territorial rights to the area in which San Jose is located, say reports.
The MLB did not comment on the matter.
