US: California, eBay throw punches in non-compete case

Following eBay’s motion to dismiss California’s antitrust lawsuit against the company over its alleged “handshake” agreement with rival Intuit, the state slammed the online retailer as unwilling “to even admit its behavior.”

    That unwillingness, the state said, is a threat that eBay will continue to make such anticompetitive agreements with Intuit.

    California Attorney General Kamala Harris, along with federal authorities, is suing eBay for the agreements made with Intuit not to hire each other’s employees. The suits claim the agreements spanned between 2006 and 2009.

    California’s lawsuit is its second, as a judge dismissed its first attempt to sue eBay over the agreements last September. The online retailer has against motioned to have this case dismissed, claiming California has no evidence that eBay is continuing such non-compete agreements.
