US: Chairman Leibowitz applauds SCourt’s ruling in state vs. federal hospital case
Following the story reported yesterday by CPI, Federal Trade Commission Chairman Leibowitz has released a statement in response to a recent Supreme Court opinion concerning a Georgia district court’s dismissal of an FTC filing to block a hospital merger. Leibowitz stated, “Today’s ruling is a big victory for consumers who want to see lower health care costs, and the Court’s opinion will ensure competition in a variety of other industries, as well.” The FTC argued the merger would drastically cut competition in its particular area and could result in increased costs for customers. The Commission appealed the district court’s decision and the Supreme Court has unanimously released an opinion declaring that state action does not immunize the hospital merger from federal law.
