The Rotterdam District Court has overturned a ruling by the Dutch Competition Authority that imposed fines on an individual, a power held by the Authority and other EU antitrust authorities. The Dutch Competition Authority ordered a fines of about €20 million to newspaper publisher Wegener and three of its executives, as well as €250,000 each to supervisory directors, over non-compliance with a merger remedy; the Rotterdam District Court has overturned the authority’s ruling against the publishing company’s individuals, ruling that individuals cannot be held liable for the infringements except in “exceptional circumstances.”
