Commission issues reasoned opinion for Bulgaria’s procedures on assigning spectrum lots
The European Commission has issued a reasoned opinion on Bulgaria’s 2009 assignment of five spectrum lots for digital terrestrial broadcasting. Bulgaria assigned the lots using two contest procedures that, in the opinion of the Commission, “limit[ed] without justification the number of undertakings that could enter the market concerned. Moreover, the selection criteria . . . were disproportionate and therefore not in line with the requirements of the Competition, Authorisation and Framework Directives.”
Bulgaria has two months to reply satisfactorily, that is, to inform the Commission of measures taken to ensure open and non-discriminatory entry into the digital terrestrial broadcasting infrastructure market.
