Supreme Court Lets CREXi Antitrust Case Against CoStar Move Forward

The U.S. Supreme Court on Monday refused to take up CoStar Group’s effort to dismiss antitrust claims brought by Commercial Real Estate Exchange, allowing a lower court ruling in favor of CREXi to stand. The justices acted without comment, according to Reuters.

    The decision leaves in place an appeals court judgment that allowed CREXi’s antitrust case to continue. CREXi, a California-based real estate data company, is seeking unspecified damages for alleged lost revenue and profits, arguing that CoStar used its market position to lock brokers into its platforms and prevent competitors from accessing important online tools, according to Reuters.

    CoStar has denied violating antitrust law and has argued that it is not required to give rivals access to its websites or databases. The dispute is part of a broader legal battle between the two companies that has been unfolding for years, per Reuters.

    CREXi raised the antitrust allegations as counterclaims in response to a copyright lawsuit CoStar filed in 2020. In that case, CoStar accused CREXi of intentionally copying tens of thousands of photographs of commercial real estate properties as part of what it described as a copyright infringement scheme, according to Reuters.

    CoStar said in a statement that CREXi’s “antitrust counterclaims are a sideshow to CoStar Group’s underlying mass copyright infringement claims against CREXi” and that the allegations would not delay the copyright infringement trial, according to Reuters.
