The potential legal action comes amid mounting scrutiny of the egg industry, as consumers continue to grapple with elevated food prices. According to Reuters, egg producers have already been facing a growing number of class action lawsuits accusing them of colluding to inflate prices. The issue has gained urgency as egg costs in the United States surged in recent years, largely due to bird flu outbreaks that wiped out millions of laying hens and severely constrained supply.

Shares of Cal-Maine Foods fell nearly 3% in extended trading following news of the possible lawsuit, per Reuters. The company had previously disclosed that it was cooperating with a Justice Department investigation into potential price-fixing practices after receiving a civil investigative demand. It noted at the time that the scope and outcome of the probe remained uncertain.

The report cited by Reuters indicates that the lawsuit centers on allegations that producers used an industry price-benchmarking service to coordinate pricing strategies. However, it also noted that the Justice Department and the companies involved could still reach a settlement before the case proceeds to court.

Neither Cal-Maine Foods nor Versova immediately responded to requests for comment from Reuters.

The developments come alongside broader inflationary pressures in the U.S. economy. According to Reuters, producer prices rose to a seven-month high in February, driven by increases in both goods and services. Data from the Producer Price Index showed that goods prices climbed 1.1% during the month. Egg prices, in particular, rebounded sharply by 93.6% after a steep 63.9% decline in January, when some tariffs were rolled back.

In addition to the egg industry, the Justice Department is reportedly conducting separate investigations into pricing practices in other agricultural markets, including beef, fertilizer, and crop seeds, according to Reuters.
