Colombia: AUTECO sues spare parts importer for unfair competition

Colombia’s Superintendence of Industry and Commerce admitted a lawsuit by car parts distributor Auteco alleging unfair competition against Mr. Carlos Arturo Henao Múnera. Mr. Henao has, says Auteco, for about two years acquired automotive spare parts in India, marked for exclusive sale in that country, and brought them them illegally to Colombia, distributing the parts through Auteco’s distribution network.

    With this practice, Auteco claims, customers would have been led to believe that the company would support and honor warranties on these ‘yellow label’ spare parts, which were improperly introduced into their chain of authorized dealers.

    Legal actions have been initiated before the SIC against importers who have been identified engaging in similar practices, in order to avoid unfair competition that confuses customers.
