La autoridad antimonopolios de España, la CNMC, elevó al Tribunal de Justicia de la Unión Europea una cuestión prejudicial, cuestionando si los puntos de acuerdo alcanzados entre los sindicatos de estibadores y la patronal para ajustar su convenio a la nueva estructura del sector se ajustan a las normas de competencia y derechos laborales de la Comunidad. La decisión deja congelado nuevamente el proceso sancionador, abierto en 2017.
