Former DOJ Antitrust Leaders Criticize Live Nation Settlement After Trial’s Abrupt End

Two former senior antitrust officials who played key roles in the U.S. Department of Justice’s case against Live Nation and Ticketmaster have publicly criticized the department’s decision to settle the lawsuit shortly after trial proceedings began, expressing confidence that the government was on track for a courtroom victory.

    Speaking at the National Independent Venue Association’s annual conference in Minneapolis on Monday, David Dahlquist, the former Deputy Director of Litigation who led the government’s case, said he remained convinced the DOJ had a strong chance of prevailing against the entertainment giant.

    “When I stood up and gave the opening statement in this case, I believed that we were going to win,” Dahlquist told attendees. “And when the settlement was entered, I still believed that we were going to win … I knew the case, I knew the witnesses, I knew the evidence.”

    According to Variety, the DOJ and more than 30 states had accused Live Nation and Ticketmaster of engaging in monopolistic practices, with the trial beginning in March. The lawsuit, which had been developed over several years under the Biden administration, ended unexpectedly after federal officials reached a settlement with the company just one week into the proceedings.

    Per Variety, the settlement followed a private meeting between DOJ officials and Live Nation representatives. The move reportedly angered U.S. District Judge Arun Subramanian, who was overseeing the case and was not expecting the agreement.

    Addressing the conduct surrounding the settlement, Judge Subramanian sharply criticized both sides. “From all sides the parties conduct here strains the bounds of responsible conduct and is inconsistent” with the principles in of the court, he said.

    Despite the federal government’s decision to settle, not all of the states involved followed suit. According to Variety, 27 states that were part of the original lawsuit chose to continue pursuing the case.

    Dahlquist also confirmed reports that neither he nor members of his litigation team participated in the negotiations that ultimately produced the settlement. His remarks suggest that the decision was made at the highest levels of government rather than by the attorneys handling the case directly.

    Variety reported that the exclusion of the trial team from the settlement discussions has fueled speculation about political involvement in the resolution. The Wall Street Journal has alleged that President Donald Trump personally intervened in the matter, although details surrounding the negotiations have not been publicly disclosed.
