Spain: Competition authority swats down City Rules

Spain’s competition watchdog has presented an injunction against parts of the Santa Cruz de Tenerife Municipal Landscape Ordnance, as well as against Chapter X, Book II of Hernani’s municipal Ordnance, considering both of these regulations as violations of Spain’s Market Unity laws.

The rules in question subject the installation of aerials and other communications infrastructure to a ‘Previous Authorization’ regime, requiring firms to await formal approval of plans before installing their equipment.

The country’s Market Unity laws, however, had sought to shorten these procedures by allowing similar operations to act under a ‘Responsible Declaration’ regime, allowing for work to begin immediately after filing a request.

Responding to the CNMC’s injunction, the Santa Cruz de Tenerife authorities have already expressed their willingness to modify the offending parts of their municipal Ordnance.
