US: Plaintiffs fail to earn class certification in CD, DVD drive price-fixing suit
A federal judge has denied class certification for two groups of plaintiffs accusing several companies of manipulating the price of DVD and CD drives.
Reports say US District Judge Richard Seeborg ruled late last week that the plaintiffs do not have sufficient expert analysis to grant class certification. One group aims to represent direct buyers, while the other aims to represent indirect buyers.
The plaintiffs accuse Sony, LG Electronic and Toshiba of colluding to prevent the price of optical disk drives from falling between 2004 and 2009 through “supply arrangements” and “alliances.”
Despite the blow to the plaintiffs, Judge Seeborg also denied the defendants’ motion to strike expert testimony put forth by the plaintiffs, reports say.
