Spain: Regulator holds annual Defense of Competition Council

Spanish market and competition regulator CNMC held last week its annual Council, gathering all the competition authorities in Spain’s autonomous communities and regions. The encounter’s aim is to promote best practices and to coordinate their efforts in Competition and promotion, as well as strengthening their mutual work programs to promote a wider culture of competition.

During the 2015 period, a total of 88 files were assigned, of which 77 were seen by autonomous community authorities. Of the 77 files taken by these communities, the largest category (25%) was made up of “associative, collegial and syndicate activities”, followed by “public administration” with 17%. The catch-all category ‘Others’, on the other hand, was dominated by 50% of cases involving funeral services.

In over half of all cases (58%) the conducts involved were those included in Article 1 of the Competition Defence Law, such as price fixing, limiting production and distribution, dividing up markets, discrimination or unnecessary additional services.
