Canada: 2019 adjustment to filing fees for merger reviews comes into effect

The Competition Bureau announced Monday, April 1, that the filing fee for merger reviews has increased from CA$72,000 to CA$73,584 (US$54,096 to US$55,286). The new filing fee comes into effect immediately.

    The filing fee is subject to an annual Consumer Price Index (CPI) adjustment pursuant to the Service Fees Act. The CPI adjustment allows the fee to keep pace with increasing costs of delivering services.

    The Competition Act requires that companies notify the Bureau if proposed mergers, acquisitions and other transactions meet certain thresholds. The Bureau reviews these notifiable transactions to determine if they are likely to substantially prevent or lessen competition. The new filing fee applies to companies filing a pre-merger notification and/or requesting an Advance Ruling Certificate.
