Sen. Shelby Calls CFPB a “Horrible Agency” as Dems Rally Around CFPB Recess Appointment

The battle is heating up over a potential CFPB recess appointment for Elizabeth Warren. Three House Democrats urged President Obama in a letter to use this procedure to make Elizabeth Warren the bureau’s director.
 
“The letter entitled ‘There is Only One Person Who Should Be Leading the Consumer Financial Protection Bureau’ was signed by Reps. Carolyn Maloney (D., N.Y.), Keith Ellison (D., Minn.) and Brad Miller (D., N.C.),” reports MarketWatch. “Many Republicans bristle at the idea of having Warren head the bureau and most observers argue that she would have a hard time capturing the filibuster-proof 60 votes needed to confirm her by the Senate.”
 
Meanwhile, Sen. Richard Shelby (R-AL) told Lou Dobbs on FOX News this week that he hoped Republicans would stay in session to block such a move.
 
“The Democrats certainly prevented a lot of the Republican nominees from getting recess appointments under President Bush,” said Shelby during the interview. “I would hope under our leadership that we will not let that happen, because the President as soon as we recess would have that authority.”
 
Shelby continued that he hoped the President would not end up making a recess appointment to fill the CFPB director position.
 
“I’d hope he would go through the regular process and do something responsible,” he said.
